Assignments of Error

1. The trial court erred by failing to grant Plaintiff/Appellant’s Motion for Leave to Amend Counts III and IV on grounds that these Counts had not been previously amended and prejudice was not shown.

3. The trial court erred by finding that Count III failed to state a viable claim for Tortious Interference with Contract and Tortious Interference with valid Business Expectancies.

4. The trial court erred by ruling that Count IV failed to (1) allege any conduct sufficient to state a claim for Breach of Contract; (2) plead the elements of a contract and how it was breached; (3) allege sufficient facts to establish a fiduciary relationship; (4) express a basis to amend which would not contradict the theories previously alleged.
