Assignment of Error

1. The Trial Court erred in granting summary judgment in favor of the defense because it did not appear from the pleadings, orders, admissions or the sustaining of a motion to strike that there were no material facts in dispute and that John Doe, Nationwide or Farm Bureau were entitled to judgment as a matter of law.
