The Trial Court erred in granting summary judgment in favor of the defense because it did not appear from the pleadings, orders, admissions or the sustaining of a motion to strike that there were no material facts in dispute and that John Doe, Nationwide or Farm Bureau were entitled to judgment as a matter of law.
