Assignment of Error

1. The Court of Appeals erred in affirming the Circuit Court's denial of the Petitioner's motion to strike the second degree murder Indictment or to merge the aggravated malicious Indictment into the second degree murder Indictment made at the close of the Commonwealth's evidence, and renewed at the close of all the evidence, and renewed again at the conclusion of the sentencing phase of the trial.
2. The Court of Appeals erred in affirming the Circuit Court's denial of the Petitioner's written Motion to Vacate the Conviction for Aggravated Malicious Wounding.
