1. The trial judge erred in failing to strike both the charges of telephone threats when the actual words and evidence show only that these messages were communicating frustration, anger, contempt and disgust as contemplated in Lofgren v. Commonwealth, 55 Va. App. 116, 684 S.E.2d 223 (2009).
